U.s. Drug Policy Critique Essay

For many years, drugs have been the center of crime and the criminal justice system in the United States. Due to this widespread epidemic, President Richard Nixon declared the “War on Drugs” in 1971 with a campaign that promoted the prohibition of illicit substances and implemented policies to discourage the overall production, distribution, and consumption. The War on Drugs and the U.S. drug policy has experienced the most significant and complex challenges between criminal law and the values of today’s society. With implemented drug polices becoming much harsher over the years in order to reduce the overall misuse and abuse of drugs and a expanded federal budget, it has sparked a nation wide debate whether or not they have created more harm than good. When looking at the negative consequences of these policies not only has billions of dollars gone to waste, but the United States has also seen public health issues, mass incarceration, and violent drug related crime within the black market in which feeds our global demands and economy. With this failed approach for drug prohibition, there continues to be an increase in the overall production of illicit substances, high rate of violence, and an unfavorable impact to our nation.

The United States has the world's highest incarceration rate. With five percent of the world's population, our country houses nearly twenty-five percent of the world's reported prisoners. Currently there are approximately two million people in American prisons or jails. Since 1984 the prison population for drug offenders has risen from ten percent to now over thirty percent of the total prison population. Federal prisons were estimated to hold 179,204 sentenced inmates in 2007; 95,446 for drug offenses. State prisons held a total of 1,296,700 inmates in 2005; 253,300 for drug offenses. Sixty percent of the drug offenders in prisons are nonviolent and were purely in prison because of drug offenses (Drug War Facts). The question then arises,

In the late 1980’s and early 1990’s, drug use became a major concern for most Americans. As the War on Drugs and “Just Say No” campaign were being thrust into the spotlight by the government and media, the public became more aware of the scope of drug use and abuse in this country. The federal and states’ governments quickly responded by creating and implementing more harsh and punitive punishments for drug offenses. Most of these laws have either remained unchanged or become stricter in the years since then.

Drugs first surfaced in the United States in the 1800s. After the Civil War opium become very popular and was used medicinally. Following opium was cocaine which was also used as a health remedy but near the end of the 19th century opium and cocaine abuse peaked and local governments began to prohibit opium dens and importation. In 1914 the first federal drug policy, the Harrison Narcotics act, is passed and drugs are no longer seen as harmless remedies. The act aggressively regulated the manufacturing of marijuana, cocaine, heroin, and morphine. During the 50’s more federal drug policies were passed and drugs began to become more criminalized. The 60’s saw a rise in counter-culture and substances such as marijuana and LSD saw widespread use. The demand for drugs skyrocketed in the 1960s. In 1971 President Nixon declared drug abuse America 's number one enemy and proclaimed that we must wave a all out offensive. After President Nixon declared the War on Drugs in 1971, the United States has spent more than a trillion dollars on this failing policy that not only has had no effect on the amount of drugs being used in the United States and has increased the number of people incarcerated on drug charges from just 50,000 to over half a million, but also has helped fuel drug cartels and foment violence and death through overdoses from uncontrolled drug potency and turf wars between street gangs.

The war on Drugs played a heavy role in minority American society. It affected policing and most importantly the American minority people. The war on drugs started by President Nixon and up until President Bush was a disaster that affected America with high incarceration and high recidivism rates for low level and non-violent drug offenses that mainly targeted minorities in America. The war on drugs was a massive American failure that mainly affected minorities. President Obama and his drug reform alongside the American public’s strong opinion to switch towards marijuana reform which we see in places like Colorado and Washington has caused the war on drugs to lose steam. Today there are half a million in prison or jail due to a drug offense, while in 1980 there were only 41,100. They have tripled since 1980. The War on Drugs began in increments, first with President Nixon and secondly with President Reagan (Hill, Oliver, Marion, 2012). While under the Nixon administration, the Drug Enforcement Administration was developed due to the thought of how drugs can affect an individual as well as a community. Drugs did not only affect the user and the community, but also the families as well as children. Out of all the presidents, it is documented that President Nixon was one who had discussions about drugs more than any other president (Hill, et al., 2012).

As a major policy issue in the United States, the War on Drugs has been one of the most monumental failures on modern record. At a cost of billions of taxpayer dollars, thousands of lives lost and many thousands of others ruined by untreated addiction or incarceration, America's policy orientation concerning drug laws is due for reconsideration. Indeed, the very philosophical orientation of the War on Drugs and of the current drug policy in the United States has been one of prosecution and imprisonment rather than one of decriminalization, treatment and rehabilitation. As our medical and scientific communities characterize addiction as a disease, the United States government continues to characterize this disease as a crime. And in doing so, it has created an unnecessary criminal class in the United States. The research, supplemental political cartoons and proposed research will set out to prove that stiffer drug laws will only have the impact of criminalizing countless drug addicts who might otherwise benefit substantially from rehabilitation and other treatment-based strategies. The War on Drugs, like the war on Terrorism, is a war that America may not be able to afford to win. For over forty years the United States has been fighting the War on Drugs and there is no end in sight. It has turned into a war that is about politics and economics rather than about drugs and criminals. The victims of this war are numerous; but perhaps they are not as numerous as those who benefit from the war itself.

The War on Drugs has been a common phrase in the United States for many decades. What exactly does this mean and how does it shape U.S. foreign policy? The War on Drugs can be defined as the systematic and aggressive policy that is determined to undermine and stop the flow of illegal drugs into the United States. This policy is backed by several U.S. institutions including the Central Intelligence Agency (CIA), Federal Bureau of Investigation (FBI), Drug Enforcement Administration (DEA), U.S. Army, U.S. Coast Guard, and U.S. Customs. Also, included in this list are the numerous local law enforcement agencies across the country.
